Terms of Service – DeluxeProShop

These terms apply to all orders placed on deluxeproshop.com.

1. Seller and scope

The seller is Deluxe Distribution Handels GmbH & Co. KG, Wilhelmine-Gemberg-Weg 6, 10179 Berlin, Germany, registered at Amtsgericht Charlottenburg (Berlin) under HRA 47692 B, VAT ID DE286869785 (“we”, “us”). Email: support@deluxeproshop.com, phone: +49 30 44013906.

These terms apply to contracts between us and our customers for goods sold on this website. A consumer is any natural person who concludes a contract for purposes outside their trade, business or profession (§ 13 BGB).

2. Contract language

The contract language is English.

3. Conclusion of contract

The products shown on our website are not a binding offer, but an invitation to place an order.
You place a binding order by adding products to the cart, entering your details at checkout, confirming these terms and clicking “Place order with obligation to pay”. Before that, you can review and correct all details.
We send you an email confirming receipt of your order. This is not yet an acceptance. The contract is concluded when we accept your order by email (order confirmation) or by shipping the goods, at the latest within two business days.
We store the contract text. You receive the order details and these terms by email. Past orders can also be viewed in your customer account, if you created one.

4. Prices

All prices are in euros (EUR) and include 19% German VAT.
Shipping costs of €6.19 per order are added and shown in the cart and at checkout before you place your order.
If a price is shown incorrectly due to an obvious error (for example a typing error), we will inform you before accepting the order and you may decide whether to order at the correct price. No contract is concluded at the incorrect price.

5. Payment

We accept Visa, Mastercard, American Express and Discover cards, processed by Stripe. Your card is charged when you place your order. Details are in our Payment Policy.

6. Delivery

We deliver within Germany only, with Deutsche Post DHL. Delivery takes 2 to 4 business days. Details are in our Shipping Policy. If a product is unexpectedly unavailable, we inform you without delay and refund any payment already made.

7. Retention of title

The goods remain our property until paid in full.

8. Right of withdrawal and returns

Consumers have a statutory right of withdrawal of 14 days. In addition, we offer a voluntary 30-day return policy with return shipping paid by us. The full withdrawal information, the model withdrawal form and our return policy are in our Return & Refund Policy.

9. Warranty

The statutory warranty rights (gesetzliche Mängelhaftung) apply. For consumers, the warranty period for new goods is two years from delivery. We do not offer an additional commercial guarantee.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and where we have given a guarantee. For slight negligence, we are only liable for breach of an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible and on which you may regularly rely), limited to the foreseeable damage typical for this type of contract. Otherwise, our liability is excluded.

11. Customer account

Creating an account is optional. You can order as a guest. Keep your password confidential. You can delete your account at any time by writing to support@deluxeproshop.com.

12. Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG). Please contact us directly with any complaint, and we will work to resolve it.

13. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not remove the protection of mandatory provisions of the law of the country where the consumer has their habitual residence.
